據(ju)新華(hua)社電國(guo)土(tu)資源部近日(ri)發(fa)出緊急(ji)通知,要(yao)求(qiu)嚴(yan)禁工(gong)商企(qi)業借“租賃”“流轉”之名,違法違規(gui)租賃農(nong)村土(tu)地進(jin)行非(fei)農(nong)業建設。
圈地影響耕地保護
記者昨天從國土資源部獲悉,近年來,一些工商企業投資農業,從事規模化經營,出現個別企業大規模租賃農地,以各種名義圈占土地,擅自改變土地用途,違法違規進行非農建設的現象,違反了土地用途管制制度,影響了耕地保護,侵害了農民利益。國土(tu)資源部通(tong)知強調,土(tu)地(di)(di)承(cheng)包(bao)經營權流轉,不(bu)得(de)改變土(tu)地(di)(di)集體所(suo)有性質,不(bu)得(de)改變土(tu)地(di)(di)用途(tu),不(bu)得(de)損害農民土(tu)地(di)(di)承(cheng)包(bao)權益。這既是(shi)承(cheng)包(bao)經營權流轉的(de)基本(ben)原則(ze),也是(shi)承(cheng)包(bao)地(di)(di)流轉中(zhong)土(tu)地(di)(di)管(guan)理的(de)基本(ben)要求。各地(di)(di)應予高度重視,按照土(tu)地(di)(di)用途(tu)管(guan)制的(de)要求,加強承(cheng)包(bao)經營權流轉中(zhong)農地(di)(di)的(de)管(guan)理,確(que)保農村土(tu)地(di)(di)使用規范有序。
必須遵循農地農用
通知說(shuo),任何單位或個(ge)人(ren)依法(fa)(fa)進(jin)行土(tu)(tu)地(di)(di)(di)(di)(di)(di)(di)承包(bao)(bao)經(jing)營(ying)權流轉(zhuan)(zhuan),包(bao)(bao)括工商企(qi)業租賃(lin)農(nong)(nong)(nong)地(di)(di)(di)(di)(di)(di)(di)從事農(nong)(nong)(nong)業生產的,必須(xu)按照土(tu)(tu)地(di)(di)(di)(di)(di)(di)(di)利(li)用總(zong)體規(gui)劃,堅持(chi)農(nong)(nong)(nong)地(di)(di)(di)(di)(di)(di)(di)農(nong)(nong)(nong)用,不得擅自改變(bian)土(tu)(tu)地(di)(di)(di)(di)(di)(di)(di)用途。使用農(nong)(nong)(nong)地(di)(di)(di)(di)(di)(di)(di)進(jin)行非農(nong)(nong)(nong)建(jian)設(she)的,必須(xu)符合土(tu)(tu)地(di)(di)(di)(di)(di)(di)(di)利(li)用總(zong)體規(gui)劃和年(nian)度土(tu)(tu)地(di)(di)(di)(di)(di)(di)(di)利(li)用計劃,依法(fa)(fa)辦(ban)理農(nong)(nong)(nong)用地(di)(di)(di)(di)(di)(di)(di)轉(zhuan)(zhuan)用審批手續(xu),涉及(ji)土(tu)(tu)地(di)(di)(di)(di)(di)(di)(di)征收的,依法(fa)(fa)辦(ban)理土(tu)(tu)地(di)(di)(di)(di)(di)(di)(di)征收審批手續(xu)。各地(di)(di)(di)(di)(di)(di)(di)應制(zhi)定辦(ban)法(fa)(fa)措施(shi),禁止任何單位或個(ge)人(ren)借“租賃(lin)”“流轉(zhuan)(zhuan)”農(nong)(nong)(nong)地(di)(di)(di)(di)(di)(di)(di)之機,或以興辦(ban)設(she)施(shi)農(nong)(nong)(nong)業為(wei)名,違(wei)規(gui)興建(jian)“配(pei)套(tao)設(she)施(shi)”,或變(bian)相興建(jian)非農(nong)(nong)(nong)設(she)施(shi),擅自從事非農(nong)(nong)(nong)建(jian)設(she)。
占用耕地從重處罰
通知(zhi)要求(qiu)各地(di)(di)強化土地(di)(di)利用監管(guan),將其納入縣、鄉(xiang)(鎮)日常土地(di)(di)巡查(cha)范圍(wei),尤其加強工商企(qi)業租賃農(nong)地(di)(di)監管(guan),對違(wei)法違(wei)規用地(di)(di)的,做到(dao)早發現、早制止(zhi)、早報告、早查(cha)處。
對于違法違規(gui)用(yong)地,依法該拆(chai)除(chu)的(de)(de)要(yao)予(yu)以拆(chai)除(chu),該復(fu)耕的(de)(de)要(yao)予(yu)以復(fu)耕;依法對違法違規(gui)用(yong)地行為處(chu)理后,確需補辦用(yong)地手續的(de)(de)建設(she)項目,有(you)(you)關(guan)稅費按(an)違法用(yong)地期間最高(gao)標準支(zhi)付和(he)繳納。涉及的(de)(de)有(you)(you)關(guan)責(ze)(ze)任單(dan)位、個人,要(yao)依法追(zhui)究法律責(ze)(ze)任,占用(yong)耕地和(he)基本農田(tian)的(de)(de),要(yao)依法從重(zhong)處(chu)罰,涉嫌犯罪(zui)的(de)(de)必須依法移(yi)送司法機關(guan)。
