為貫徹(che)落(luo)實新修訂(ding)的(de)《中(zhong)華人(ren)民共和(he)國(guo)行政(zheng)(zheng)處(chu)罰法(fa)》,進(jin)一步(bu)規(gui)范(fan)行政(zheng)(zheng)處(chu)罰裁量權,促進(jin)市場(chang)監(jian)管(guan)(guan)部門嚴格規(gui)范(fan)公正(zheng)文明執法(fa),市場(chang)監(jian)管(guan)(guan)總局(ju)組織對《市場(chang)監(jian)管(guan)(guan)總局(ju)關于(yu)規(gui)范(fan)市場(chang)監(jian)督管(guan)(guan)理行政(zheng)(zheng)處(chu)罰裁量權的(de)指導(dao)(dao)意見》(以下簡稱《指導(dao)(dao)意見》)進(jin)行了修訂(ding),于(yu)2022年10月8日正(zheng)式印發。市場(chang)監(jian)管(guan)(guan)總局(ju)法(fa)規(gui)司負責人(ren)就涉及《指導(dao)(dao)意見》的(de)相(xiang)關問題回答記者提(ti)問。
問:請簡要介紹一下《指導意見》修訂的背景?
答:2019年(nian)12月24日(ri),總(zong)局(ju)(ju)印發《市(shi)場監(jian)管總(zong)局(ju)(ju)關(guan)于(yu)規范(fan)市(shi)場監(jian)督(du)管理行(xing)(xing)(xing)(xing)(xing)政(zheng)(zheng)處罰裁量(liang)權(quan)的(de)(de)指(zhi)導意見(jian)》(國市(shi)監(jian)法(fa)(fa)(fa)(fa)〔2019〕244號(hao)),對(dui)推(tui)動市(shi)場監(jian)管部門規范(fan)行(xing)(xing)(xing)(xing)(xing)使(shi)行(xing)(xing)(xing)(xing)(xing)政(zheng)(zheng)處罰裁量(liang)權(quan),科學制(zhi)定(ding)(ding)(ding)行(xing)(xing)(xing)(xing)(xing)政(zheng)(zheng)處罰裁量(liang)基準起到了(le)積(ji)極作(zuo)(zuo)用。2021年(nian)7月15日(ri),新(xin)修(xiu)訂的(de)(de)行(xing)(xing)(xing)(xing)(xing)政(zheng)(zheng)處罰法(fa)(fa)(fa)(fa)正(zheng)式實施,對(dui)不(bu)予行(xing)(xing)(xing)(xing)(xing)政(zheng)(zheng)處罰、從輕減輕行(xing)(xing)(xing)(xing)(xing)政(zheng)(zheng)處罰、從重行(xing)(xing)(xing)(xing)(xing)政(zheng)(zheng)處罰等內容作(zuo)(zuo)出新(xin)的(de)(de)規定(ding)(ding)(ding)。2022年(nian)7月29日(ri),國務院辦公(gong)廳印發《國務院辦公(gong)廳關(guan)于(yu)進一(yi)步規范(fan)行(xing)(xing)(xing)(xing)(xing)政(zheng)(zheng)裁量(liang)權(quan)基準制(zhi)定(ding)(ding)(ding)和管理工作(zuo)(zuo)的(de)(de)意見(jian)》(國辦發〔2022〕27號(hao)),對(dui)行(xing)(xing)(xing)(xing)(xing)政(zheng)(zheng)處罰裁量(liang)權(quan)基準制(zhi)定(ding)(ding)(ding)和管理工作(zuo)(zuo)提出新(xin)的(de)(de)要求(qiu)。為貫(guan)徹(che)落實新(xin)修(xiu)訂的(de)(de)行(xing)(xing)(xing)(xing)(xing)政(zheng)(zheng)處罰法(fa)(fa)(fa)(fa)和國務院意見(jian)要求(qiu),更好地保(bao)護市(shi)場主體和人民(min)群眾合法(fa)(fa)(fa)(fa)權(quan)益,切實維護公(gong)平競爭的(de)(de)市(shi)場秩(zhi)序,實現政(zheng)(zheng)治效(xiao)果、社會效(xiao)果、法(fa)(fa)(fa)(fa)律(lv)效(xiao)果的(de)(de)統一(yi),市(shi)場監(jian)管總(zong)局(ju)(ju)對(dui)《指(zhi)導意見(jian)》進行(xing)(xing)(xing)(xing)(xing)了(le)修(xiu)訂。
問:《指導意見》在規范行政處罰裁量權行使、促進嚴格規范公正文明執法方面有哪些亮點?
答:針(zhen)對當(dang)前市(shi)場監管(guan)執(zhi)法的(de)新(xin)趨勢新(xin)情況,秉持執(zhi)法為民的(de)理(li)念(nian),結合基(ji)層(ceng)執(zhi)法工作實際,總(zong)局在新(xin)修訂的(de)《指導(dao)意見》中(zhong)明(ming)(ming)確(que)(que)以(yi)下內容(rong),著力規(gui)(gui)(gui)范行(xing)(xing)(xing)政處(chu)罰裁(cai)量權,彰(zhang)顯(xian)執(zhi)法力度和溫度的(de)統一。一是(shi)(shi)在行(xing)(xing)(xing)政處(chu)罰裁(cai)量權行(xing)(xing)(xing)使的(de)基(ji)本原(yuan)則中(zhong)增加(jia)公(gong)平公(gong)正原(yuan)則,防止出現處(chu)罰畸輕畸重、類案不同(tong)罰等現象(xiang),穩(wen)定(ding)市(shi)場預期。二是(shi)(shi)針(zhen)對個(ge)案中(zhong)適(shi)用(yong)(yong)行(xing)(xing)(xing)政處(chu)罰裁(cai)量權基(ji)準(zhun)(zhun)可(ke)能(neng)出現明(ming)(ming)顯(xian)不當(dang)、顯(xian)失(shi)公(gong)平等情形(xing),增加(jia)經過(guo)一定(ding)程(cheng)序可(ke)以(yi)調整適(shi)用(yong)(yong)的(de)規(gui)(gui)(gui)定(ding),最大程(cheng)度保護市(shi)場主體(ti)和人(ren)民群眾利益。三是(shi)(shi)明(ming)(ming)確(que)(que)需要(yao)在法定(ding)處(chu)罰種類或者幅度以(yi)下減輕行(xing)(xing)(xing)政處(chu)罰的(de),在明(ming)(ming)確(que)(que)具體(ti)情節(jie)、適(shi)用(yong)(yong)條(tiao)件和處(chu)罰標準(zhun)(zhun)前,應當(dang)嚴格進行(xing)(xing)(xing)評估(gu),避免(mian)裁(cai)量權濫用(yong)(yong)。四(si)是(shi)(shi)在強調市(shi)場監管(guan)部門實施行(xing)(xing)(xing)政處(chu)罰應當(dang)以(yi)法律、法規(gui)(gui)(gui)、規(gui)(gui)(gui)章(zhang)為依據的(de)同(tong)時,明(ming)(ming)確(que)(que)有行(xing)(xing)(xing)政處(chu)罰裁(cai)量權基(ji)準(zhun)(zhun)的(de),要(yao)在行(xing)(xing)(xing)政執(zhi)法決定(ding)書中(zhong)對行(xing)(xing)(xing)政處(chu)罰裁(cai)量權基(ji)準(zhun)(zhun)的(de)適(shi)用(yong)(yong)情況予以(yi)明(ming)(ming)確(que)(que)。
問:為了貫徹落實新修訂的行政處罰法,《指導意見》對行政處罰裁量權的適用規則作出了哪些修訂?
答:為全面落實新修(xiu)訂(ding)的(de)行政(zheng)處(chu)(chu)罰法(fa)(fa),本次(ci)修(xiu)訂(ding)重點對(dui)《指(zhi)導意見》中與(yu)新法(fa)(fa)規(gui)定不(bu)(bu)一致、不(bu)(bu)銜接、不(bu)(bu)配套的(de)內容作(zuo)出修(xiu)改。一是(shi)按照過(guo)罰相(xiang)(xiang)當、寬嚴相(xiang)(xiang)濟的(de)原則,對(dui)行政(zheng)處(chu)(chu)罰的(de)裁量情(qing)形(xing)(xing)作(zuo)出修(xiu)訂(ding)。增(zeng)(zeng)加了依法(fa)(fa)應當不(bu)(bu)予處(chu)(chu)罰、應當從(cong)(cong)輕或(huo)者減輕處(chu)(chu)罰、可以(yi)(yi)(yi)從(cong)(cong)輕或(huo)者減輕處(chu)(chu)罰的(de)情(qing)形(xing)(xing),減少了可以(yi)(yi)(yi)從(cong)(cong)重處(chu)(chu)罰的(de)情(qing)形(xing)(xing),同時(shi)對(dui)其中多項情(qing)形(xing)(xing)作(zuo)出修(xiu)正,從(cong)(cong)制度層面推動行政(zheng)處(chu)(chu)罰裁量適當,確保處(chu)(chu)罰裁量基準(zhun)于法(fa)(fa)有(you)據(ju)。二是(shi)增(zeng)(zeng)加了依法(fa)(fa)可以(yi)(yi)(yi)不(bu)(bu)予處(chu)(chu)罰的(de)情(qing)形(xing)(xing),增(zeng)(zeng)加“首(shou)違不(bu)(bu)罰”的(de)規(gui)定,同時(shi)將有(you)證(zheng)據(ju)足(zu)以(yi)(yi)(yi)證(zheng)明沒有(you)主觀過(guo)錯列(lie)為不(bu)(bu)予處(chu)(chu)罰情(qing)形(xing)(xing),體現(xian)寬嚴相(xiang)(xiang)濟。三是(shi)增(zeng)(zeng)加了應當從(cong)(cong)重處(chu)(chu)罰的(de)情(qing)形(xing)(xing),對(dui)于法(fa)(fa)律、法(fa)(fa)規(gui)、規(gui)章(zhang)規(gui)定應當從(cong)(cong)重處(chu)(chu)罰的(de),依法(fa)(fa)從(cong)(cong)重處(chu)(chu)罰。
問:《指導意見》對行政處罰裁量權基準制定和管理工作有哪些規定和要求?
答:行(xing)政(zheng)(zheng)處(chu)罰(fa)裁(cai)量(liang)(liang)權(quan)(quan)基(ji)準(zhun)是(shi)(shi)行(xing)政(zheng)(zheng)機關實施(shi)行(xing)政(zheng)(zheng)處(chu)罰(fa)的(de)具(ju)(ju)體(ti)尺度(du)和(he)標準(zhun)。《指(zhi)導(dao)意(yi)見》聚焦當前(qian)行(xing)政(zheng)(zheng)處(chu)罰(fa)裁(cai)量(liang)(liang)權(quan)(quan)基(ji)準(zhun)制(zhi)定(ding)和(he)管(guan)(guan)理(li)工(gong)作中(zhong)存在的(de)實際(ji)問題,提出以(yi)下(xia)具(ju)(ju)體(ti)要求。一是(shi)(shi)規(gui)(gui)(gui)定(ding)了制(zhi)定(ding)主體(ti)的(de)職責(ze)權(quan)(quan)限。明確了省級(ji)(ji)和(he)設區的(de)市(shi)級(ji)(ji)市(shi)場(chang)(chang)監(jian)(jian)(jian)管(guan)(guan)部(bu)門(men)(men)可以(yi)制(zhi)定(ding)行(xing)政(zheng)(zheng)處(chu)罰(fa)裁(cai)量(liang)(liang)權(quan)(quan)基(ji)準(zhun)。二是(shi)(shi)要求原(yuan)則(ze)上不重復制(zhi)定(ding)行(xing)政(zheng)(zheng)處(chu)罰(fa)裁(cai)量(liang)(liang)權(quan)(quan)基(ji)準(zhun)。《指(zhi)導(dao)意(yi)見》規(gui)(gui)(gui)定(ding),對(dui)同(tong)一行(xing)政(zheng)(zheng)處(chu)罰(fa)事(shi)項,上級(ji)(ji)市(shi)場(chang)(chang)監(jian)(jian)(jian)管(guan)(guan)部(bu)門(men)(men)已經制(zhi)定(ding)行(xing)政(zheng)(zheng)處(chu)罰(fa)裁(cai)量(liang)(liang)權(quan)(quan)基(ji)準(zhun)的(de),下(xia)級(ji)(ji)市(shi)場(chang)(chang)監(jian)(jian)(jian)管(guan)(guan)部(bu)門(men)(men)原(yuan)則(ze)上應當直接(jie)適(shi)用;如(ru)下(xia)級(ji)(ji)市(shi)場(chang)(chang)監(jian)(jian)(jian)管(guan)(guan)部(bu)門(men)(men)不能(neng)直接(jie)適(shi)用,可以(yi)結合地區經濟社會(hui)發展狀(zhuang)況,在法(fa)(fa)律(lv)、法(fa)(fa)規(gui)(gui)(gui)、規(gui)(gui)(gui)章(zhang)規(gui)(gui)(gui)定(ding)的(de)行(xing)政(zheng)(zheng)處(chu)罰(fa)裁(cai)量(liang)(liang)權(quan)(quan)范(fan)圍內進(jin)行(xing)合理(li)細(xi)化量(liang)(liang)化,但不能(neng)超出上級(ji)(ji)市(shi)場(chang)(chang)監(jian)(jian)(jian)管(guan)(guan)部(bu)門(men)(men)劃定(ding)的(de)階次或者幅度(du)。三(san)是(shi)(shi)強(qiang)化日常監(jian)(jian)(jian)督管(guan)(guan)理(li)。規(gui)(gui)(gui)定(ding)各級(ji)(ji)市(shi)場(chang)(chang)監(jian)(jian)(jian)管(guan)(guan)部(bu)門(men)(men)要依(yi)照《市(shi)場(chang)(chang)監(jian)(jian)(jian)督管(guan)(guan)理(li)執法(fa)(fa)監(jian)(jian)(jian)督暫行(xing)規(gui)(gui)(gui)定(ding)》(市(shi)場(chang)(chang)監(jian)(jian)(jian)管(guan)(guan)總(zong)局令第22號),加強(qiang)對(dui)行(xing)政(zheng)(zheng)處(chu)罰(fa)裁(cai)量(liang)(liang)權(quan)(quan)基(ji)準(zhun)制(zhi)度(du)執行(xing)情況的(de)監(jian)(jian)(jian)督檢查,同(tong)時要建立行(xing)政(zheng)(zheng)處(chu)罰(fa)裁(cai)量(liang)(liang)權(quan)(quan)基(ji)準(zhun)動態調整(zheng)機制(zhi),根據法(fa)(fa)律(lv)、法(fa)(fa)規(gui)(gui)(gui)、規(gui)(gui)(gui)章(zhang)的(de)修改以(yi)及(ji)客觀情況的(de)變化,及(ji)時進(jin)行(xing)調整(zheng)。通過上述(shu)規(gui)(gui)(gui)定(ding),推動實現(xian)行(xing)政(zheng)(zheng)處(chu)罰(fa)裁(cai)量(liang)(liang)標準(zhun)制(zhi)度(du)化、行(xing)為(wei)規(gui)(gui)(gui)范(fan)化、管(guan)(guan)理(li)科學化。
問:在推進《指導意見》的貫徹落實方面,下一步總局還將做哪些工作?
答:為推動(dong)各(ge)級市場(chang)監(jian)管部門做(zuo)好(hao)行(xing)(xing)政處(chu)(chu)罰(fa)裁(cai)量權基準制定和(he)管理(li)工(gong)(gong)作(zuo)(zuo)(zuo),持(chi)續規范(fan)行(xing)(xing)政處(chu)(chu)罰(fa)裁(cai)量權,下(xia)一步(bu),我們將著力做(zuo)好(hao)《指導意(yi)見》的組(zu)織(zhi)實(shi)施以及(ji)相關立法工(gong)(gong)作(zuo)(zuo)(zuo)。一是(shi)繼(ji)續做(zuo)好(hao)不合理(li)罰(fa)款事項的清(qing)理(li)工(gong)(gong)作(zuo)(zuo)(zuo),推動(dong)修訂或(huo)廢止一批行(xing)(xing)政法規和(he)規章(zhang)。二(er)是(shi)研究制定《國家市場(chang)監(jian)督(du)管理(li)總(zong)局法治(zhi)(zhi)建設評(ping)(ping)價辦法》,將行(xing)(xing)政裁(cai)量權基準制定和(he)管理(li)工(gong)(gong)作(zuo)(zuo)(zuo)納入法治(zhi)(zhi)市場(chang)監(jian)管建設考評(ping)(ping)指標體系,明確任(ren)務(wu),落實(shi)責任(ren)。三是(shi)適時組(zu)織(zhi)開展行(xing)(xing)政處(chu)(chu)罰(fa)案卷評(ping)(ping)查(cha),加強類案指導和(he)行(xing)(xing)政執法檢(jian)查(cha),總(zong)結推廣典型經(jing)驗,研究解決共(gong)性(xing)問題,督(du)促做(zuo)好(hao)貫徹落實(shi)工(gong)(gong)作(zuo)(zuo)(zuo)。
