中共中央辦公廳 國務院辦公廳關于進一步強化食品安全全鏈條監管的意見

  一、完善食用農產(chan)品協同監(jian)管

  (一(yi))嚴格落(luo)(luo)實(shi)食(shi)用(yong)農(nong)(nong)(nong)(nong)(nong)產(chan)品質(zhi)(zhi)量(liang)(liang)安(an)(an)全(quan)監管職責。生(sheng)態環境部門(men)負責推(tui)進農(nong)(nong)(nong)(nong)(nong)用(yong)地土(tu)壤重金屬(shu)污染(ran)溯源和整治。農(nong)(nong)(nong)(nong)(nong)業農(nong)(nong)(nong)(nong)(nong)村部門(men)負責履行食(shi)用(yong)農(nong)(nong)(nong)(nong)(nong)產(chan)品從種植養殖到進入(ru)批(pi)(pi)發(fa)、零(ling)(ling)售(shou)市(shi)(shi)場(chang)或生(sheng)產(chan)加工企業前的質(zhi)(zhi)量(liang)(liang)安(an)(an)全(quan)監管職責;市(shi)(shi)場(chang)監管部門(men)負責履行食(shi)用(yong)農(nong)(nong)(nong)(nong)(nong)產(chan)品進入(ru)批(pi)(pi)發(fa)、零(ling)(ling)售(shou)市(shi)(shi)場(chang)或生(sheng)產(chan)加工企業后(hou)的質(zhi)(zhi)量(liang)(liang)安(an)(an)全(quan)監管職責。縣(xian)級(ji)以上(shang)地方政府要認真落(luo)(luo)實(shi)食(shi)用(yong)農(nong)(nong)(nong)(nong)(nong)產(chan)品質(zhi)(zhi)量(liang)(liang)安(an)(an)全(quan)屬(shu)地管理(li)責任(ren),加強監管能力建(jian)設,研究(jiu)解決本級(ji)食(shi)用(yong)農(nong)(nong)(nong)(nong)(nong)產(chan)品質(zhi)(zhi)量(liang)(liang)安(an)(an)全(quan)監管中的職能交叉和監管空白(bai)問(wen)題,避免出現監管漏(lou)洞和盲區。鄉(xiang)鎮政府要落(luo)(luo)實(shi)食(shi)用(yong)農(nong)(nong)(nong)(nong)(nong)產(chan)品質(zhi)(zhi)量(liang)(liang)安(an)(an)全(quan)監管責任(ren)。

  (二)加強(qiang)食用(yong)(yong)(yong)農(nong)產(chan)(chan)(chan)品(pin)(pin)(pin)(pin)產(chan)(chan)(chan)地準(zhun)出(chu)與(yu)市(shi)(shi)(shi)場(chang)(chang)(chang)準(zhun)入(ru)銜接。農(nong)業(ye)農(nong)村部門(men)和市(shi)(shi)(shi)場(chang)(chang)(chang)監(jian)管部門(men)要加強(qiang)協調配合,切實發(fa)揮(hui)承(cheng)諾達標合格(ge)證(zheng)在食用(yong)(yong)(yong)農(nong)產(chan)(chan)(chan)品(pin)(pin)(pin)(pin)產(chan)(chan)(chan)地準(zhun)出(chu)與(yu)市(shi)(shi)(shi)場(chang)(chang)(chang)準(zhun)入(ru)中的銜接作用(yong)(yong)(yong)。農(nong)業(ye)農(nong)村部門(men)要做好承(cheng)諾達標合格(ge)證(zheng)開(kai)具(ju)、使用(yong)(yong)(yong)相關工(gong)作的指(zhi)導服務和監(jian)督檢查,對(dui)未(wei)按規定開(kai)具(ju)承(cheng)諾達標合格(ge)證(zheng)的依(yi)法予以查處(chu),加強(qiang)食用(yong)(yong)(yong)農(nong)產(chan)(chan)(chan)品(pin)(pin)(pin)(pin)上市(shi)(shi)(shi)前(qian)禁限(xian)用(yong)(yong)(yong)藥物和易超標常規藥物殘留速測(ce)把關。市(shi)(shi)(shi)場(chang)(chang)(chang)監(jian)管部門(men)要督促食品(pin)(pin)(pin)(pin)生產(chan)(chan)(chan)經營(ying)者(zhe)強(qiang)化進貨查驗,指(zhi)導食用(yong)(yong)(yong)農(nong)產(chan)(chan)(chan)品(pin)(pin)(pin)(pin)批發(fa)市(shi)(shi)(shi)場(chang)(chang)(chang)依(yi)法開(kai)展入(ru)場(chang)(chang)(chang)查驗和抽(chou)樣檢驗,加大(da)禁限(xian)用(yong)(yong)(yong)藥物和易超標常規藥物殘留速測(ce)力度(du)。鼓勵食品(pin)(pin)(pin)(pin)生產(chan)(chan)(chan)經營(ying)者(zhe)優先采購附具(ju)承(cheng)諾達標合格(ge)證(zheng)的食用(yong)(yong)(yong)農(nong)產(chan)(chan)(chan)品(pin)(pin)(pin)(pin)。建立(li)承(cheng)諾達標合格(ge)證(zheng)問題通報協查機制,完善(shan)不合格(ge)產(chan)(chan)(chan)品(pin)(pin)(pin)(pin)閉環處(chu)置流程。

  (三(san))強化肉(rou)類(lei)產(chan)品(pin)(pin)檢(jian)(jian)(jian)驗(yan)(yan)檢(jian)(jian)(jian)疫(yi)出證(zheng)查(cha)驗(yan)(yan)。農(nong)業(ye)農(nong)村(cun)(cun)部(bu)門(men)要(yao)強化肉(rou)類(lei)產(chan)品(pin)(pin)檢(jian)(jian)(jian)驗(yan)(yan)檢(jian)(jian)(jian)疫(yi)出證(zheng)管(guan)理,建立完(wan)善屠(tu)宰檢(jian)(jian)(jian)疫(yi)出證(zheng)信(xin)息(xi)(xi)化系(xi)統,推進(jin)肉(rou)類(lei)產(chan)品(pin)(pin)品(pin)(pin)質檢(jian)(jian)(jian)驗(yan)(yan)無紙化出證(zheng),明確檢(jian)(jian)(jian)驗(yan)(yan)檢(jian)(jian)(jian)疫(yi)證(zheng)明公(gong)開查(cha)驗(yan)(yan)途徑。完(wan)善禁止(zhi)對牲畜(chu)、禽類(lei)注水或注入其他物質的相關(guan)規(gui)定。市場監(jian)管(guan)部(bu)門(men)要(yao)督促(cu)食品(pin)(pin)生產(chan)經營者將(jiang)肉(rou)類(lei)產(chan)品(pin)(pin)檢(jian)(jian)(jian)驗(yan)(yan)檢(jian)(jian)(jian)疫(yi)合格證(zheng)明作為肉(rou)類(lei)產(chan)品(pin)(pin)進(jin)貨查(cha)驗(yan)(yan)的基礎憑(ping)證(zheng);積極探索應(ying)用(yong)信(xin)息(xi)(xi)化手段(duan),加強與(yu)農(nong)業(ye)農(nong)村(cun)(cun)部(bu)門(men)的信(xin)息(xi)(xi)共(gong)享和互聯互通。

  (四(si))加(jia)快建立食(shi)用(yong)農(nong)產(chan)品(pin)(pin)(pin)質(zhi)量(liang)(liang)安(an)全追(zhui)溯(su)(su)協(xie)作(zuo)和執法合作(zuo)機制。農(nong)業農(nong)村(cun)部要會同市場(chang)監(jian)管(guan)(guan)總局等部門制定食(shi)用(yong)農(nong)產(chan)品(pin)(pin)(pin)質(zhi)量(liang)(liang)安(an)全追(zhui)溯(su)(su)管(guan)(guan)理(li)辦法,建立健全食(shi)用(yong)農(nong)產(chan)品(pin)(pin)(pin)質(zhi)量(liang)(liang)安(an)全追(zhui)溯(su)(su)目錄(lu)。農(nong)業農(nong)村(cun)、市場(chang)監(jian)管(guan)(guan)部門要建立食(shi)用(yong)農(nong)產(chan)品(pin)(pin)(pin)質(zhi)量(liang)(liang)安(an)全監(jian)管(guan)(guan)信息共享及反(fan)饋機制,加(jia)強(qiang)食(shi)用(yong)農(nong)產(chan)品(pin)(pin)(pin)質(zhi)量(liang)(liang)安(an)全風險防范(fan),強(qiang)化輿情監(jian)測和應急處(chu)置協(xie)調聯動;密切食(shi)用(yong)農(nong)產(chan)品(pin)(pin)(pin)質(zhi)量(liang)(liang)安(an)全行政(zheng)執法協(xie)調協(xie)作(zuo),對突出問題進行專項(xiang)治理(li)整頓(dun)。

  二(er)、強化食品生(sheng)產經營(ying)許可審查(cha)

  (五)規范(fan)食(shi)(shi)品(pin)(pin)生產(chan)經(jing)營市場(chang)準(zhun)入。食(shi)(shi)品(pin)(pin)生產(chan)經(jing)營許(xu)可(ke)部門應(ying)嚴格落實(shi)許(xu)可(ke)審查要求,嚴禁擅自(zi)改變許(xu)可(ke)條件或(huo)未經(jing)審查即予(yu)許(xu)可(ke),省級以(yi)(yi)上市場(chang)監管(guan)部門要對食(shi)(shi)品(pin)(pin)生產(chan)經(jing)營許(xu)可(ke)實(shi)施情況進行督(du)導檢(jian)查。地方(fang)政府指定(ding)(ding)市場(chang)監管(guan)部門以(yi)(yi)外的(de)(de)部門實(shi)施許(xu)可(ke)的(de)(de),應(ying)符合法(fa)律(lv)授權(quan)規定(ding)(ding),明(ming)確申請受理、材(cai)料(liao)審查、現場(chang)核查、許(xu)可(ke)決定(ding)(ding)責任分工(gong)(gong),完善許(xu)可(ke)和監管(guan)工(gong)(gong)作(zuo)銜(xian)接機制。加(jia)(jia)強傳統特(te)色(se)食(shi)(shi)品(pin)(pin)加(jia)(jia)工(gong)(gong)制作(zuo)工(gong)(gong)藝保護,與現代檢(jian)測技(ji)術有(you)機銜(xian)接,確保食(shi)(shi)品(pin)(pin)特(te)色(se)和質量安全。

  (六)完善特(te)殊(shu)食品(pin)(pin)注冊許(xu)可制度。省級以上市場(chang)監(jian)管部門(men)依職責嚴格開(kai)展特(te)殊(shu)食品(pin)(pin)注冊、備案、生(sheng)產許(xu)可審查,對(dui)符合條件的重點(dian)品(pin)(pin)種(zhong)實施(shi)優先審評審批。市場(chang)監(jian)管總(zong)局和(he)(he)國家(jia)衛生(sheng)健(jian)康委(wei)要加強協作,開(kai)展特(te)殊(shu)食品(pin)(pin)技術聯動、專(zhuan)家(jia)聯審;統籌完善食品(pin)(pin)健(jian)康聲(sheng)稱和(he)(he)保健(jian)食品(pin)(pin)功能(neng)聲(sheng)稱相關(guan)工作。

  (七)完(wan)善(shan)(shan)食(shi)品安全(quan)檢(jian)(jian)(jian)查(cha)員(yuan)(yuan)制(zhi)度(du)。市場監管(guan)部門要(yao)加強食(shi)品安全(quan)檢(jian)(jian)(jian)查(cha)履職能(neng)力建設,進一步完(wan)善(shan)(shan)食(shi)品安全(quan)檢(jian)(jian)(jian)查(cha)員(yuan)(yuan)制(zhi)度(du),做好(hao)許可審(shen)查(cha)、監督檢(jian)(jian)(jian)查(cha)、注冊核查(cha)等專(zhuan)業檢(jian)(jian)(jian)查(cha)工作。強化(hua)培(pei)訓考(kao)核和(he)統一調配使用(yong),提升專(zhuan)業檢(jian)(jian)(jian)查(cha)能(neng)力和(he)水平。

  三(san)、加快建立食品貯存監管機(ji)制

  (八)加(jia)(jia)(jia)強食(shi)(shi)品(pin)貯(zhu)(zhu)存(cun)安全(quan)監(jian)管(guan)。農業農村、海關、市場監(jian)管(guan)、糧食(shi)(shi)和(he)儲備等(deng)部(bu)門依(yi)職(zhi)責建立(li)健全(quan)食(shi)(shi)品(pin)貯(zhu)(zhu)存(cun)監(jian)管(guan)制(zhi)度,明確監(jian)管(guan)要求。加(jia)(jia)(jia)強對從事食(shi)(shi)用農產(chan)品(pin)、食(shi)(shi)品(pin)、食(shi)(shi)品(pin)添加(jia)(jia)(jia)劑及(ji)食(shi)(shi)品(pin)原料(liao)等(deng)貯(zhu)(zhu)存(cun)主體的(de)監(jian)督檢查,規范貯(zhu)(zhu)存(cun)經營行為。

  (九)落實食(shi)(shi)(shi)(shi)品(pin)(pin)貯(zhu)存主體責任。食(shi)(shi)(shi)(shi)品(pin)(pin)貯(zhu)存主體應建立完善(shan)食(shi)(shi)(shi)(shi)品(pin)(pin)安全管理(li)制度,保(bao)證必備的(de)(de)食(shi)(shi)(shi)(shi)品(pin)(pin)貯(zhu)存條件,實施食(shi)(shi)(shi)(shi)品(pin)(pin)貯(zhu)存全過(guo)程(cheng)記錄,嚴格風(feng)險管控。食(shi)(shi)(shi)(shi)品(pin)(pin)貯(zhu)存委托(tuo)方(fang)應對(dui)受托(tuo)方(fang)的(de)(de)食(shi)(shi)(shi)(shi)品(pin)(pin)安全保(bao)障能力(li)進(jin)行審核,并監督受托(tuo)方(fang)按照保(bao)證食(shi)(shi)(shi)(shi)品(pin)(pin)安全的(de)(de)要求(qiu)進(jin)行貯(zhu)存。食(shi)(shi)(shi)(shi)品(pin)(pin)貯(zhu)存委托(tuo)方(fang)和受托(tuo)方(fang)應當明確入(ru)庫(ku)出庫(ku)交付查驗要求(qiu),嚴格交付銜接和入(ru)庫(ku)出庫(ku)管理(li)。

  (十)強化食品(pin)貯(zhu)(zhu)存屬地(di)管理(li)責(ze)任。縣級(ji)以(yi)上地(di)方(fang)政府應明確食品(pin)貯(zhu)(zhu)存的部門監管和行(xing)業管理(li)責(ze)任,督促屬地(di)食品(pin)貯(zhu)(zhu)存主體(ti)落實食品(pin)安(an)全責(ze)任。非食品(pin)生(sheng)產(chan)經營者從事對溫度(du)、濕度(du)等(deng)有特殊要求(qiu)食品(pin)貯(zhu)(zhu)存業務的,應納入食品(pin)安(an)全監管范圍。

  四、加快建(jian)立食品運輸協同監管機制

  (十一)建立實施散(san)裝液(ye)態食(shi)(shi)品(pin)(pin)運(yun)輸(shu)準(zhun)運(yun)制(zhi)(zhi)度。依法建立散(san)裝液(ye)態食(shi)(shi)品(pin)(pin)運(yun)輸(shu)準(zhun)運(yun)制(zhi)(zhi)度,明確(que)運(yun)輸(shu)散(san)裝液(ye)態食(shi)(shi)品(pin)(pin)車輛的(de)食(shi)(shi)品(pin)(pin)安全準(zhun)入(ru)條(tiao)件(jian)和技(ji)術標準(zhun),核發食(shi)(shi)品(pin)(pin)準(zhun)運(yun)證明,確(que)保(bao)專車專用。制(zhi)(zhi)定(ding)實行運(yun)輸(shu)準(zhun)運(yun)制(zhi)(zhi)度的(de)散(san)裝液(ye)態食(shi)(shi)品(pin)(pin)重點品(pin)(pin)種目錄。

  (十二)加強食(shi)品(pin)(pin)運(yun)(yun)輸(shu)(shu)全過程監(jian)(jian)(jian)管。市場監(jian)(jian)(jian)管部門(men)要會(hui)同交通運(yun)(yun)輸(shu)(shu)、農(nong)業(ye)農(nong)村、糧食(shi)和儲備(bei)等(deng)部門(men)建立健全對食(shi)品(pin)(pin)和食(shi)用農(nong)產品(pin)(pin)運(yun)(yun)輸(shu)(shu)發貨(huo)方、承運(yun)(yun)方、收貨(huo)方的(de)協同監(jian)(jian)(jian)管機(ji)制,研究(jiu)制定運(yun)(yun)輸(shu)(shu)電子聯單(dan)管理(li)要求,加強交付、裝卸、運(yun)(yun)輸(shu)(shu)管理(li)和運(yun)(yun)輸(shu)(shu)工(gong)具日(ri)常(chang)管理(li),強化從業(ye)人員(yuan)教育培(pei)訓,壓實(shi)各方食(shi)品(pin)(pin)安全主體責任(ren),防范污染變質風險(xian)。

  五、健全(quan)食(shi)品(pin)寄(ji)遞安(an)全(quan)和配送安(an)全(quan)管理

  (十三)強(qiang)化食(shi)品寄遞安全(quan)管(guan)理(li)(li)。郵政(zheng)(zheng)(zheng)管(guan)理(li)(li)部門要(yao)督促(cu)郵政(zheng)(zheng)(zheng)企業、快遞企業落(luo)實(shi)(shi)實(shi)(shi)名(ming)收(shou)寄、收(shou)寄驗(yan)視、過(guo)機安檢制(zhi)度(du),防范利用(yong)(yong)寄遞渠道寄遞假冒偽(wei)劣食(shi)品。郵政(zheng)(zheng)(zheng)管(guan)理(li)(li)部門要(yao)與市場(chang)監管(guan)等部門加強(qiang)協作(zuo),加大對寄遞環節涉食(shi)品安全(quan)違法線(xian)索的(de)核(he)查處置(zhi)力度(du),依法打(da)擊利用(yong)(yong)寄遞渠道銷售假冒偽(wei)劣食(shi)品的(de)違法行為。

  (十(shi)四)加強(qiang)網絡(luo)訂餐配送(song)(song)安(an)全管(guan)理(li)。市場監管(guan)部(bu)門要督促(cu)網絡(luo)訂餐平臺、餐飲經(jing)營者履(lv)行食品安(an)全法(fa)律(lv)法(fa)規規定的(de)義(yi)務(wu),落實(shi)(shi)網絡(luo)訂餐配送(song)(song)環節食品安(an)全責(ze)任。人力資(zi)源(yuan)社會(hui)保障(zhang)部(bu)門要將(jiang)掌握食品安(an)全法(fa)律(lv)知(zhi)識納入網約配送(song)(song)員國(guo)家(jia)職業(ye)技能(neng)標準(zhun)。網絡(luo)訂餐平臺、餐飲經(jing)營者應根據國(guo)家(jia)職業(ye)技能(neng)標準(zhun),結合實(shi)(shi)際建立適(shi)合網絡(luo)訂餐配送(song)(song)行業(ye)勞動(dong)者的(de)培訓模式,強(qiang)化食品安(an)全法(fa)律(lv)知(zhi)識培訓。

  六、加強網絡食品(pin)銷售新(xin)業態監管(guan)

  (十五)壓實(shi)網(wang)(wang)絡食(shi)(shi)品銷(xiao)(xiao)(xiao)售從業主(zhu)體責任(ren)。網(wang)(wang)絡交(jiao)易平臺企業要(yao)(yao)按規(gui)定設(she)置(zhi)專門(men)的食(shi)(shi)品安(an)全(quan)管理(li)機(ji)構(gou)或指定專職食(shi)(shi)品安(an)全(quan)管理(li)人員;嚴格(ge)審查食(shi)(shi)品生產(chan)經(jing)營(ying)者入網(wang)(wang)銷(xiao)(xiao)(xiao)售主(zhu)體資質,規(gui)范(fan)主(zhu)體信息、食(shi)(shi)品信息刊(kan)載公示,依法(fa)(fa)(fa)對(dui)食(shi)(shi)用(yong)農產(chan)品承諾達標(biao)合(he)格(ge)證展(zhan)示、藥物殘留檢測(ce)等進行(xing)檢查把關;加強入網(wang)(wang)銷(xiao)(xiao)(xiao)售行(xing)為(wei)過程管控(kong),及(ji)時發現違(wei)規(gui)行(xing)為(wei)并作出相應(ying)處置(zhi)。主(zhu)播(bo)及(ji)其服務機(ji)構(gou)要(yao)(yao)規(gui)范(fan)開展(zhan)營(ying)銷(xiao)(xiao)(xiao)活動,依法(fa)(fa)(fa)對(dui)其推薦的食(shi)(shi)品進行(xing)查驗。廣告活動參與(yu)者要(yao)(yao)依法(fa)(fa)(fa)開展(zhan)食(shi)(shi)品類互聯網(wang)(wang)廣告設(she)計、制作、代理(li)、發布等。食(shi)(shi)品生產(chan)經(jing)營(ying)者要(yao)(yao)嚴把質量安(an)全(quan)關,保持線上線下同標(biao)同質。從業主(zhu)體明知或應(ying)知產(chan)品違(wei)法(fa)(fa)(fa)但未采取相關處置(zhi)措施的,依法(fa)(fa)(fa)承擔相應(ying)責任(ren)。

  (十六)強化(hua)網(wang)絡銷售(shou)食(shi)品(pin)(pin)安(an)全問(wen)題(ti)協同(tong)治理。市場(chang)監(jian)管部門(men)要會(hui)同(tong)農(nong)業農(nong)村、工業和(he)信(xin)息(xi)(xi)化(hua)、網(wang)信(xin)、廣(guang)電等(deng)(deng)部門(men)明確直播帶貨、私域電商、社區團購等(deng)(deng)網(wang)絡食(shi)品(pin)(pin)銷售(shou)新業態治理要求,依職責加強網(wang)絡銷售(shou)食(shi)品(pin)(pin)安(an)全問(wen)題(ti)信(xin)息(xi)(xi)監(jian)測通報(bao)和(he)協查處(chu)置。網(wang)信(xin)部門(men)對各部門(men)通報(bao)的網(wang)絡銷售(shou)食(shi)品(pin)(pin)安(an)全方(fang)面的不實虛假信(xin)息(xi)(xi)配合做好相(xiang)應處(chu)置工作。強化(hua)行(xing)(xing)政處(chu)罰和(he)刑事處(chu)罰雙向銜接,依法打擊違法犯罪行(xing)(xing)為。

  七、健(jian)全餐飲(yin)服(fu)務(wu)綜合監管(guan)機制

  (十七)加強(qiang)網(wang)(wang)絡訂餐線上線下一體(ti)化(hua)(hua)監管(guan)。市(shi)場監管(guan)部門(men)要會(hui)(hui)同(tong)工業和(he)信(xin)息化(hua)(hua)、網(wang)(wang)信(xin)等(deng)部門(men)對存在食品安全嚴重違法情(qing)形的平(ping)臺依(yi)法處(chu)置(zhi)。推動(dong)平(ping)臺和(he)商戶實行“互(hu)聯網(wang)(wang)+明廚亮灶”,強(qiang)化(hua)(hua)無堂(tang)食外(wai)賣監管(guan)和(he)社(she)會(hui)(hui)監督(du)。

  (十八(ba))強化集(ji)(ji)中用餐單(dan)(dan)位(wei)(wei)食(shi)品(pin)安全協同(tong)管(guan)理(li)。教育、民政、衛生健康等部門要(yao)強化對本行(xing)業集(ji)(ji)中用餐單(dan)(dan)位(wei)(wei)的食(shi)品(pin)安全教育和日常管(guan)理(li)。市場監管(guan)部門要(yao)強化集(ji)(ji)中用餐單(dan)(dan)位(wei)(wei)食(shi)品(pin)安全監督(du)檢查(cha)及抽檢監測,依法查(cha)處違法行(xing)為(wei)并(bing)通(tong)報(bao)同(tong)級(ji)行(xing)業主管(guan)部門。

  (十(shi)九(jiu))完善(shan)校園(yuan)食(shi)(shi)品(pin)(pin)安全(quan)(quan)協同(tong)(tong)管(guan)(guan)理(li)機(ji)制。教育部(bu)(bu)(bu)門(men)(men)要會(hui)同(tong)(tong)農業農村、市(shi)(shi)場監(jian)管(guan)(guan)部(bu)(bu)(bu)門(men)(men)建(jian)立(li)健全(quan)(quan)學(xue)校食(shi)(shi)堂食(shi)(shi)品(pin)(pin)安全(quan)(quan)全(quan)(quan)過程管(guan)(guan)理(li)制度。教育部(bu)(bu)(bu)門(men)(men)要加強對學(xue)校食(shi)(shi)品(pin)(pin)安全(quan)(quan)相關工(gong)作的統籌管(guan)(guan)理(li)和指導,完善(shan)學(xue)校食(shi)(shi)堂大宗食(shi)(shi)材供(gong)(gong)應(ying)(ying)商(shang)資質(zhi)(zhi)評(ping)審制度,建(jian)立(li)供(gong)(gong)應(ying)(ying)商(shang)不良記錄清單,推動優質(zhi)(zhi)安全(quan)(quan)食(shi)(shi)材進入學(xue)校食(shi)(shi)堂。推動學(xue)校食(shi)(shi)堂大宗食(shi)(shi)材集(ji)中招標采購(gou),建(jian)立(li)采購(gou)數字化平(ping)臺,規(gui)范(fan)食(shi)(shi)材采購(gou)、供(gong)(gong)應(ying)(ying)、驗收、結算(suan)等流程。教育部(bu)(bu)(bu)門(men)(men)要指導中小學(xue)校園(yuan)膳(shan)食(shi)(shi)監(jian)督家長委(wei)員會(hui)高效(xiao)規(gui)范(fan)運行,會(hui)同(tong)(tong)市(shi)(shi)場監(jian)管(guan)(guan)等部(bu)(bu)(bu)門(men)(men)及(ji)時(shi)辦(ban)理(li)反饋或直送(song)的問題。市(shi)(shi)場監(jian)管(guan)(guan)部(bu)(bu)(bu)門(men)(men)要嚴格承(cheng)包經(jing)營(ying)(ying)、食(shi)(shi)材供(gong)(gong)應(ying)(ying)、供(gong)(gong)餐等經(jing)營(ying)(ying)主體準(zhun)入許可(ke),依(yi)法(fa)查(cha)處涉及(ji)學(xue)校食(shi)(shi)品(pin)(pin)安全(quan)(quan)違法(fa)行為。

  八、完善(shan)進(jin)口食品(pin)風險聯防聯控機制

  (二十)強化進(jin)口(kou)(kou)食品(pin)(pin)(pin)部(bu)門監管聯(lian)動(dong)。境外發(fa)生的(de)食品(pin)(pin)(pin)安(an)全事件可能(neng)對(dui)我國境內造成影響,或者在進(jin)口(kou)(kou)食品(pin)(pin)(pin)中發(fa)現(xian)嚴重食品(pin)(pin)(pin)安(an)全問(wen)題的(de),海(hai)關(guan)應當(dang)及(ji)時(shi)采取(qu)風(feng)險預警或者控制措施(shi)(shi),并(bing)向同級市(shi)場監管、衛生健康、農業農村部(bu)門通(tong)報,接到通(tong)報的(de)部(bu)門應當(dang)及(ji)時(shi)采取(qu)相應措施(shi)(shi),并(bing)向海(hai)關(guan)反饋。市(shi)場監管部(bu)門發(fa)現(xian)國內市(shi)場上銷售的(de)進(jin)口(kou)(kou)食品(pin)(pin)(pin)存在嚴重食品(pin)(pin)(pin)安(an)全問(wen)題,或者在生產加工(gong)環節發(fa)現(xian)企業將(jiang)進(jin)口(kou)(kou)的(de)非食品(pin)(pin)(pin)原料用于食品(pin)(pin)(pin)生產加工(gong)的(de),應當(dang)及(ji)時(shi)采取(qu)風(feng)險防控措施(shi)(shi),依(yi)法依(yi)規處置并(bing)向同級海(hai)關(guan)通(tong)報;海(hai)關(guan)對(dui)市(shi)場監管部(bu)門通(tong)報的(de)問(wen)題,應及(ji)時(shi)開(kai)展風(feng)險評(ping)估,并(bing)根(gen)據評(ping)估情況依(yi)法依(yi)規處置。有(you)關(guan)部(bu)門應依(yi)職責加強對(dui)綜合(he)保稅區等海(hai)關(guan)特殊監管區域內食品(pin)(pin)(pin)生產經營的(de)安(an)全監管。

  (二十一)完善跨(kua)境(jing)電商零售(shou)(shou)進口食(shi)(shi)(shi)(shi)(shi)品監(jian)(jian)管(guan)制度(du)。商務(wu)部(bu)要(yao)會(hui)同海(hai)關(guan)總署、市場(chang)(chang)監(jian)(jian)管(guan)總局建立跨(kua)境(jing)電商零售(shou)(shou)進口食(shi)(shi)(shi)(shi)(shi)品負面清單(dan),將(jiang)明令(ling)暫(zan)停(ting)進口的疫區食(shi)(shi)(shi)(shi)(shi)品以(yi)及(ji)因出現重大(da)質量安(an)全(quan)風(feng)險(xian)啟動應急處置的食(shi)(shi)(shi)(shi)(shi)品等(deng)列入(ru)負面清單(dan)并(bing)實時(shi)調(diao)整(zheng)。海(hai)關(guan)要(yao)根(gen)據市場(chang)(chang)監(jian)(jian)管(guan)部(bu)門(men)需(xu)要(yao),按規定提供跨(kua)境(jing)電商企業、平臺及(ji)境(jing)內(nei)服務(wu)商等(deng)相關(guan)信息,及(ji)時(shi)開展食(shi)(shi)(shi)(shi)(shi)品安(an)全(quan)風(feng)險(xian)信息交流。市場(chang)(chang)監(jian)(jian)管(guan)總局、商務(wu)部(bu)等(deng)部(bu)門(men)要(yao)進一步明確跨(kua)境(jing)電商零售(shou)(shou)進口食(shi)(shi)(shi)(shi)(shi)品召回(hui)(hui)責任。市場(chang)(chang)監(jian)(jian)管(guan)部(bu)門(men)要(yao)加大(da)召回(hui)(hui)監(jian)(jian)管(guan)力度(du),督(du)促(cu)相關(guan)責任方及(ji)時(shi)召回(hui)(hui)。

  九、加強組織實(shi)施

  各(ge)(ge)地(di)區各(ge)(ge)有關部門(men)(men)要(yao)高度重視食(shi)品安全(quan)(quan)工作(zuo),在黨中央(yang)集中統(tong)(tong)一領導(dao)下,強化組(zu)織領導(dao),結合(he)實(shi)際(ji)抓(zhua)好(hao)本意(yi)見貫徹落實(shi)。國務院食(shi)品安全(quan)(quan)委(wei)員會及其(qi)辦(ban)公室(shi)要(yao)充分發揮統(tong)(tong)籌協(xie)調(diao)指導(dao)作(zuo)用(yong),整合(he)優化食(shi)品安全(quan)(quan)領域技術資源(yuan),提高支撐保(bao)障能力(li)。各(ge)(ge)有關部門(men)(men)要(yao)各(ge)(ge)負其(qi)責、有效協(xie)同,確保(bao)食(shi)品安全(quan)(quan)全(quan)(quan)鏈(lian)條、各(ge)(ge)環節監管有機銜接(jie),責任全(quan)(quan)面落實(shi)。重大事項及時(shi)按(an)程序(xu)向黨中央(yang)、國務院請示報告。
