成都發布家裝消費提示:認準防偽標識,警惕合同陷阱

家(jia)庭裝修是消費(fei)(fei)(fei)(fei)者(zhe)安(an)居的重要(yao)環節,但合(he)同簽訂(ding)也會(hui)暗藏風險(xian)。近期,成(cheng)都市出(chu)現個別裝修公司通過偽(wei)造示(shi)范合(he)同封面、擅自刪改(gai)條(tiao)款(kuan)等方式(shi)侵害消費(fei)(fei)(fei)(fei)者(zhe)權益(yi)的情(qing)況。為幫助消費(fei)(fei)(fei)(fei)者(zhe)規避(bi)風險(xian),近日,成(cheng)都市消委(wei)會(hui)與成(cheng)都市建筑裝飾(shi)協會(hui)(以下簡稱(cheng)“成(cheng)都裝協”)聯(lian)合(he)發(fa)布消費(fei)(fei)(fei)(fei)提示(shi):簽訂(ding)家(jia)裝合(he)同時,務必認準(zhun)官方防偽(wei)標識,警惕假冒示(shi)范合(he)同。
日前,成(cheng)(cheng)都(dou)(dou)市消(xiao)(xiao)(xiao)(xiao)(xiao)委(wei)(wei)(wei)會(hui)就(jiu)處理了(le)(le)一起(qi)典型案(an)例。消(xiao)(xiao)(xiao)(xiao)(xiao)費者柯先(xian)生(sheng)與(yu)成(cheng)(cheng)都(dou)(dou)某(mou)裝(zhuang)(zhuang)飾(shi)公(gong)司簽(qian)訂(ding)了(le)(le)家庭裝(zhuang)(zhuang)飾(shi)裝(zhuang)(zhuang)修(xiu)工程施工合(he)同(tong)(tong)。后因發現合(he)同(tong)(tong)材(cai)料明細與(yu)約定(ding)不符,柯先(xian)生(sheng)到成(cheng)(cheng)都(dou)(dou)市消(xiao)(xiao)(xiao)(xiao)(xiao)委(wei)(wei)(wei)會(hui)進(jin)行投(tou)(tou)訴。在投(tou)(tou)訴處理過(guo)程中(zhong),成(cheng)(cheng)都(dou)(dou)市消(xiao)(xiao)(xiao)(xiao)(xiao)委(wei)(wei)(wei)會(hui)發現柯先(xian)生(sheng)與(yu)被投(tou)(tou)訴公(gong)司簽(qian)訂(ding)的(de)(de)合(he)同(tong)(tong)封面印有(you)“成(cheng)(cheng)都(dou)(dou)市保護消(xiao)(xiao)(xiao)(xiao)(xiao)費者權益委(wei)(wei)(wei)員會(hui) 成(cheng)(cheng)都(dou)(dou)市建筑(zhu)裝(zhuang)(zhuang)飾(shi)協(xie)會(hui)編(bian)制(zhi)(zhi)”字樣(yang),但對成(cheng)(cheng)都(dou)(dou)市消(xiao)(xiao)(xiao)(xiao)(xiao)委(wei)(wei)(wei)會(hui)及成(cheng)(cheng)都(dou)(dou)裝(zhuang)(zhuang)協(xie)共同(tong)(tong)編(bian)制(zhi)(zhi)的(de)(de)示范(fan)合(he)同(tong)(tong)文本進(jin)行了(le)(le)大量刪改(gai),合(he)同(tong)(tong)內容(rong)存在許多不利于消(xiao)(xiao)(xiao)(xiao)(xiao)費者的(de)(de)條款。成(cheng)(cheng)都(dou)(dou)市消(xiao)(xiao)(xiao)(xiao)(xiao)委(wei)(wei)(wei)會(hui)聯合(he)成(cheng)(cheng)都(dou)(dou)裝(zhuang)(zhuang)協(xie)對該(gai)公(gong)司進(jin)行了(le)(le)約談,嚴正指出該(gai)公(gong)司的(de)(de)違(wei)法(fa)行為,并要(yao)求立(li)即整改(gai)。目前該(gai)投(tou)(tou)訴已經調解結(jie)案(an),涉案(an)公(gong)司已將整改(gai)致歉函送至(zhi)成(cheng)(cheng)都(dou)(dou)市消(xiao)(xiao)(xiao)(xiao)(xiao)委(wei)(wei)(wei)會(hui)及成(cheng)(cheng)都(dou)(dou)裝(zhuang)(zhuang)協(xie)。
針(zhen)對(dui)個別擅自修改(gai)示(shi)范合(he)(he)同(tong)內(nei)容、偽(wei)造合(he)(he)同(tong)封(feng)(feng)面(mian)(mian)騙取消(xiao)費(fei)者(zhe)信任的(de)不良商(shang)家,成(cheng)(cheng)(cheng)(cheng)都(dou)市消(xiao)委(wei)會、成(cheng)(cheng)(cheng)(cheng)都(dou)裝協(xie)在此鄭重(zhong)警告:擅自修改(gai)示(shi)范合(he)(he)同(tong)內(nei)容卻仍使用示(shi)范合(he)(he)同(tong)封(feng)(feng)面(mian)(mian)誤(wu)導(dao)欺騙消(xiao)費(fei)者(zhe)的(de)行(xing)為,不僅嚴重(zhong)侵害了消(xiao)費(fei)者(zhe)的(de)知情權和公平(ping)交易權,在一定程度(du)上(shang)對(dui)成(cheng)(cheng)(cheng)(cheng)都(dou)市消(xiao)委(wei)會、成(cheng)(cheng)(cheng)(cheng)都(dou)裝協(xie)的(de)名(ming)譽以及公信力也造成(cheng)(cheng)(cheng)(cheng)了損害,對(dui)于經營者(zhe)使用自制合(he)(he)同(tong)卻打著(zhu)成(cheng)(cheng)(cheng)(cheng)都(dou)市消(xiao)委(wei)會、成(cheng)(cheng)(cheng)(cheng)都(dou)裝協(xie)名(ming)義進行(xing)“包裝認(ren)證”的(de)行(xing)為,成(cheng)(cheng)(cheng)(cheng)都(dou)市消(xiao)委(wei)會、成(cheng)(cheng)(cheng)(cheng)都(dou)裝協(xie)將依法保留追究其(qi)法律責任的(de)權利(li)。
同(tong)(tong)時(shi),為維(wei)護消(xiao)(xiao)費者合法權益(yi),防止更多消(xiao)(xiao)費者被誤導,成都市消(xiao)(xiao)委會、成都裝協鄭重提醒廣大消(xiao)(xiao)費者:警(jing)惕假冒(mao)示范(fan)合同(tong)(tong),認(ren)準防偽(wei)標(biao)識(shi)(shi)。消(xiao)(xiao)費者可通(tong)過“住宅裝飾信息(xi)服務平臺(tai)”微信小程序查詢示范(fan)合同(tong)(tong)文本,同(tong)(tong)時(shi)注意查看防偽(wei)標(biao)識(shi)(shi)。
1.示范(fan)合(he)同具(ju)有唯一編碼(共7位數,且不以“年份(fen)”為(wei)編號依據),消費(fei)者可撥打成(cheng)都裝協咨詢熱線:028-6523 3735,了解企業備案情況,確保合(he)同真(zhen)實性;
2.封面(mian)底部印有合同編制單位,由成都市保(bao)護(hu)消費者權(quan)益(yi)委員會、成都市建筑裝飾協(xie)會聯合印制;
3.封面右下角印有“住宅裝飾信息服務(wu)平臺”二維碼(ma),掃碼(ma)可(ke)查看示(shi)范合(he)同(tong)文本(ben),消費者(zhe)可(ke)參考核對(dui)合(he)同(tong)條款是否(fou)完善(2025年版示(shi)范合(he)同(tong)共12個(ge)合(he)同(tong)附件)。
